Bad Faith Insurance Litigation & Coverage Disputes

When dealing with an insured loss, your insurance company is supposed to work with you, protect you and provide the necessary relief and coverage promised under your insurance policy. Unfortunately, it is not until after suffering a loss and filing a claim that a great number of individuals learn that many insurance companies do not live up to the promises contained within their own insurance policies. Rather than working with you, many insurance companies actively work against you, solely in an effort to unfairly minimize claims and/or improperly deny coverage. These bad faith insurance practices are the last thing you need to deal with after suffering a loss.

Under Georgia law, insurance companies can be punished for bad faith insurance practices. Specifically, O.C.G.A. § 33-4-6 provides that an insurance company that acts in bad faith may be liable to the insured, in addition to the loss itself, for 50% of the liability and all reasonable attorneys' fees. Common bad faith practices prevalent in the insurance industry include:

  • Denying coverage without fully reviewing and investigating the claim;
  • Denying coverage without reason;
  • Creating hurdles during the claim process
  • Improper adjustment of the claim;
  • Proposing settlement offers much less than the claim is worth; and,
  • Unnecessarily delaying payment of the claim.
